Babydolls shut down and all employees arrested (photos included)

     The Nacogdoches County Sheriff’s office shut down the club Babydolls Saturday night for violating an order regarding the laws of Sexually Oriented Businesses. All employees were arrested and charged with a misdemeanor crime of operating the establishment without a license.

Exact wording of the
“NACOGDOCHES COUNTY SEXUALLY ORIENTED BUSINESS ORDER”
(3) ADULT CABARET means a night club, bar, restaurant, or similar commercial establishment which regularly features:

A. Persons who appear in a state of nudity; or
B. Live performances which are characterized by the exposure of “specified anatomical area” or by “specified sexual activities”; or
C. Films, motion pictures, video cassettes, slides, or other photographic reproductions which are characterized by the depiction or description of “specified sexual activities” or “specified anatomical area”.

    I saw on KETX TV that a place called “Double D” in Tyler is having similiar problems. Spent half million dollars and They are ready to open with about 150 employees and the church crowd have gone to court and gotten an injunction.

    The fact that this is even an issue on a Vistor’s site for the county of Nacogdoches is an embarrassment. Let this club conduct business, let these girls alone, stay home and go do your shopping where you wish. I am no longer sure I even want to move my family here. Not because of the club, but because of the way apparently the people of Nacogdoches treat their own. And this is your Police Department? WOW

      This was not the police department. This situation involved the Nacogdoches County Sheriff’s Office and the Constable’s Office. You should be glad to move your family to a city with law enforcement that serves and protects as well as the officers in this county do.

I don’t think any employee argues that if they had been informed by the Sheriff’s Dept. now over 4 months ago, that they even were required to have the license, when Thomas Kerss was in the club, they would have complied. This new charge suddenly ‘appeared’?? In Gregg Co. everyone working at one of the ‘bikini bars”, does not have the license. However, the next street down-is nude so they do. Seeing how BabyDolls is the only club of its kind in Nac. Co. there is example to measure by. In complience with the law that was drawn under the “Joe Evans” era, everything was set with this club in mind. At that time, due to the 1000 ft. law, due to a residence, “Showgirls” all nude club changed to Babydolls “bikini”. I know because I was working on my own Business and Management Degree THERE during this time. Every employee there past and present knows more of what is involved in this club than you do. It’s like saying you don’t like a movie without having watched it, getting your opinion from others. You may not leave your house, listen to music, drink, or enjoy dancing of any sort, which is your right. But you can not say that this type of job is a Real job, or not honest work, or somehow these people are beneath every other citizen of the county is critical, unfair, and wrong.

    Yes dancing is an honest living bcuz customers come in to see people honestly dancing half naked! If it’s all about “honesty” then cops n judges n sheriffs alike need not exist! Every human has a fetish (sexual fantasy/desire) and dancng happens to b 1 of the many fetishes in existence! Probably one of the cleanest, too! How many women/men have “toys/x rated movies” tucked away in ur closet/mattress? If this was discovered would u want pics posted/be arrested for possessing these things? Should u need a license to buy/own them/use them? I guess baby oil n chocolate syrup should b removed from store shelves too?     First of all, this is the dumbest thing I’ve heard all week. Only in East Texas can a place get raided by “the fuZZ” and they let all the filthy perverts go home.

    Secondly, all they needed were a few permits. A little paperwork and some money to “the man” would have kept Boss Hogg and Roscoe from getting too excited. It’s not like they were breaking “The Law.” They were “allegedly” breaking “A Law” that hasn’t been in place for very long. “A Law” that is enforced by the same man who issues permits to allow for the exact same activity. This is where the corruption and “double standard” begins to reveal itself.

    Yes, I agree that the business owner and management staff should have been more proactive in staying abreast of the local laws and regulations. I also believe that the local government should be more helpful in keeping the business informed of changing regulations.

    Unfortunately, people don’t always behave in a positive and responsible manner. The rules are clear. Everyone involved in this case is a responsible adult who has the ability to choose his or her own actions. There are a select few who are aware of the individuals who have been habitually breaking the rules (and violating this particular ordinance).

    Personally, I believe the old adage of “An ounce of prevention is worth a pound of cure.” The business owner and management staff should have been more strict with the dancers. It doesn’t matter what permits you have (or don’t have) if you don’t hold individuals accountable for their actions.

    Thirdly, do you really need to shut down an entire business and arrest everyone in site because a boobie popps out or someone gestures a sexual reference? Sounds to me like pretty much any public place in this great country. Oh yeah, having alcohol present makes this type of thing a horrible sin. Get real! This is obviously a witch hunt and our friendly NacaPoPo’s show exactly how to execute it properly.

    In conclusion, I would like to express my support for the unsuspecting young ladies who were simply there to earn a day’s wages. I’m thankful they were working and not sitting at home trying to thieve off of me or the government. Often times, life choices result as a matter of consequence and not by choice. It’s a shame the Nacogdoches police department didn’t handle things differently. If everyone really was in there getting “down and dirty” then I’m sure it would have been a much more popular weekend destination.

    The comments on this page are beyond ridiculous. To those of you who criticize law enforcement for “making, changing, and enforcing the rules”… that IS the job of law enforcement. Welcome to reality, someone has to keep order in this country. It is up to Kerss and his deputies to follow the laws that the county sets. There are comments about how much money the club brings in to this city, perhaps the people of this city should find better and more appropriate ways to put money back into the system for fields and schools. I would not want my child’s school funded by the local dance club. Find better things to do with your time than go watch young women dance on a stage.

      Hey Jane, different strokes for different folks. You don’t want to go to a bikini bar then don’t go. Some people enjoy watching young ladies and drinking cold beer.

      Also, the point is the law has not changed, but after FIFTEEN years Kerss all of a sudden decides that Baby Dolls is in violation of the law and calls all the media outlets to be present for the raid. If the place had just opened last month I might buy your argument, but fifteen years later. Come on.

        This club has been shut down before for violations. But my comment about making the laws was made because several people on here are complaining that Kerss is out of line for writing the affidavit and arresting people. That is his job, is all I was trying to get across. People should not complain about the Sheriff’s Office doing its job. It’s absurd so many people are acting as if it is a tragedy that this place got negative public attention.

          Well, he is out of line. It was no secret that the club was there for fifteen plus years. What is the reasoning for calling all the media outlets and making a big to do as if this were some new violation that just occurred? Furthermore there were no violations anyway. They caught one girl with a little weed, big deal. Probably 100 pounds or more of pot passes by everyday on 59.

          This injustice, this will not stand man.

            If there was no probable cause for arrest, the courts would not have allowed the NCSO to go on Saturday night. UC officers have been in and out of this club for the last 10 months. Obviously they acquired enough cause to warrant the arrests and require the place to have the correct licenses.

              So does this mean my tax dollars are paying for the Sheriffs deputies to drink beer and get table dances? Great use of resources guys. I sure am going to sleep a lot better tonight knowing that there is know dancing going on down by the river.

                To receive the warrant there was enough probable cause and evidence presented to the county court for Kerss to execute it. And of course tax dollars pay for the County Sheriff’s Office to operate, how else would they perform drug busts and UC stings to keep criminals and drugs out of the county. It’s unfortunate they had to waste resources and time on a dump like this, perhaps the owners and management should have kept it up better and no one would be complaining.

                  I will have to agree with you that the place was a dump and an eyesore that should have been kept up better, but this is nothing new either. The place has been a dump for years, so what has changed now?

                  I do resent the fact that my tax dollars funded Roscoe and his buddies going out and partying at Baby Dolls for 10 months. I can just hear Roscoe now, “Aw just one more weekend sheriff, we ain’t quite got enuff evidence yet!”

                  It will be interesting to see what happens in court. If this goes to court. I may just show up to watch the circus. My prediction is that Lostracco will offer them all plea deals to a lesser charge or deffered ajudication in an attempt for the county to save face.

              Jane, I do not wish to personally attack you, as others seem to have. Just for a second all is asked- do you blindly believe everything you read or have been told, simply because it is what is should be. The moral issue is what is at stake here. Not whether or not you or others believe or not that this club should or should not be in existence. Whether or not it is an embarrassment as far as appearance goes, but the fact that local law enforcement went in without proper authority/warrants to seize WHAT? Clearly, the pictures show no nudity, when that was not found, they searched for drugs (without a warrant) (without probable cause) and found only one instance from one person who was not even in the building, then to save face to the media who was there beforehand, brought a trump charge of a license that was not even required by the club (when the SO was there 4 months ago (and is in charge of issuing said license), arrests everyone? That would be akin to you sitting in your home watching tv, with a knock on your door, saying it is suddenly illegal to watch tv. And you would be arrested. And you would be on the internet. And your children would..i could go on. Simply put, this club does not send its “dirty” laundry out into public. Most likely the children of Nac. Co. did not even know of its existance, unless their parents brought it up. Now it seems to be the talk of the town, where as it wasn’t. However, total belief in thinking a police department is without corruption is a dangerous thing. Other counties which have numerous clubs such as this and they (the clubs and counties thrive) are laughing and just waiting on Nac. Co. tax dollars.

                I can understand the moral issue being brought up with this situation. People believe certain authorities had an agenda to see this place disappear. However, the law enforcement of Nacogdoches County is not corrupt and does not take action in the name of the law without follow the laws they swore to protect. Thus, there WERE proper warrants for what happened Saturday. Drugs WERE found ON site. Upon entering the club, nudity WAS witnessed by law enforcement, as it had been witnessed prior to the arrests by UC officers. I stand by the Constable’s Office and the Sheriff’s Office of Nacogdoches on their decision to investigate this club and their actions against it. If people feel the officers present that Saturday were out of line in their searches, perhaps they should express their concern to the county court who WROTE them the warrants they received to search the club.

                  The judge that signed the warrant did so based on the affidavit provided by Kerss. How is the judge to blame? This SNAFU is the making of Tommy boy Kerss. He sure wanted to take credit with the media last week.

                  Your claiming drugs were found on site and that there was nudity when officers raided the club . Were do you get your info from because I was there and drugs were found on ONE employee who entered the building after the raid started. And as far as nudity there was none and thats the facts. So unless you are one of the officers involved or one of the press then you should as I have stated to you before stop believing everything you read and see in the press.

              They (3) officers came in the very night before, and chased a man in that had been at a club ACROSS the highway and the Babydolls bouncers helped apprend this one. He came in there TO HIDE. Nothing was sais or done at that time….why?? No media?

          There are much more professional, peacefull ways of getting rid of Kerss’s “eye sore”. When he was in the club three months prior to this mischiver, he could have warned, reflagged, or at least told the managment to shut it down quietly. During non working hours, that would have been a much more successful clean up. As a mother of a six year old who happily likes to bring in the morning paper, I wasn’t quite prepared to explain why there were half naked women on the FRONT page. That was an eye sore for my family. At least these women kept it behind closed doors, that we can choose to enter or not. I’m truly disappointed in the handling by law-enforcement, this could have been done much quieter and still reported to the community.

            Agreed!!! The fact is that the sheriff wanted it to be a big deal. He thought everyone would be so impressed by his big take down. Reelection doesn’t just happen on it’s own. I just feel so bad for the children of these women starting school. We all live in small towns and talk spreads. They are gonna be teased and tormented for the rest of their lives for what their moms were doing up there. Judged and disrespected. The media was wrong in their judgement of newsworthiness and protecting the innocent.

          Jane…do your research. Last time this club was in “trouble” was in the mid-90’s…due to the fact at the time the club WAS nude..with no license. Once that fact was brought to the attention to the manager (at the time) the club changed to a ‘bikini’ club under which it has operated ever since. The ISSUE here is not that the club was or was not operating as required. The ISSUE is (1) the sheriff was INSIDE the club himself less than 4 months ago, checked all licenses that were needed and found to be intact. (2) local media was notified and was ‘on-hand’ for the circus. (3) when no ‘nudity’ was found, the charge went to drugs. (4) if nudity was the original issue; why drug dogs? (5) photos were taken of person(s) without a warrent, probable cause, and illegal search and seizure (which had no evidence regardless), (6) persons who were not on the premises AT ALL are now on the ‘mugshot’s ‘ portion of this and other websites, (7) person’s involved were detained, booked, and let out of the NCSO under their own PR bond(s) in on less than 14 hours, approx. 12 hours after all bonds had been posted AND approved by a JP. (8) these arrested persons were not read their rights although questioned and (9) these arrests were conducted when the County Attorney was out of town? Read the small print before passing judgement. Just because someone has a badge they are not corrupt? I am sure that your local SD has good people, but that does not mean they are not human and tend to look out for number 1.

      sorry Jane, your child’s school IS partially funded by the local “strip” club, the local liquor store, the local bars, just as much as your local Dollar Tree and Walgreens. They pay taxes. City, County, State, and Federal, TAXES. As I’m sure you do each year. These taxes are determined by the population of the county, and how much revenue each business each brings in. It would hard for a citizen to determine how much each business contributes unless you have that kind of time on your hands. However, I am sorry to let you know regardless of wherever you live, there are going to be some businesses and yes, some people who contribute to your way of living, that you don’t agree with whether you recognize that or not. Get away from the fact you don’t like this lifestyle or not. The issue here and has been, this was illegal search and seizure and harrassment. If we don’t stand up to this treatment, who is next??

          Illegal search and seizure means SEARCHING, and detaining person or person(s) WITHOUT a warrant!! There was no stinkin’ warrant….And as for the nudity???????? One of the girls was still in T-shirt and jeans, who was arrested. None of the girls were ‘allowed’ to dress (in their street clothes, to avoid being taken to jail in a swimsuit) and EVERY picture has EVERY girl dressed in exactly what they were wearing when raided. Duh.

    Is the city of Nacogoches going to recogize that Babydolls brought in over 500,000 to a MILLION dollars in the past year to this county? I suppose that paid for baseball fields, improvements in some way. If you don’t agree with the things that supposedly go on there (all though you’d have to go). the county still took the money. this club paid taxes. each year. We took money from the dancers to help the homeless, children without food, and mothers had baby showers which took care of their and their babies needs when they had no where to go. And for this, a bogus license charge when no nudity and no drugs were found?? I love my city, i was born here. But to put inoccent people out of work, because it’s an ’embarrassment”? Now, I’m embarrassed to live in such a prudish non-forgiving, judmental city”. Shame on the local sheriff for this trying to get a local vote. i am german, even i understand a dicatorship. how do you make the rules, can’t get the license unless from ‘me’, and then when you don’t have it..i arrest you? me..me..me…don’t you see this? sheep are easily led.

Long time business owner plus my family goes back to the WWII in Nacogdoches. You would be surprised who I am. But the only business which has ‘held’ on at the Angelina River is this club after Angelina went wet, and our current law enforcement’s way of conducting business is outta wack.

Does no one realize that regardless of whether or not the current license was in place at the time or day, this is about harrassing people who are now unemployed. They (the dancers) were with a job. Now without a job, who those of us with a job must now support? Let them dance, they were not out in the street. They were not out in public. They were not with out education. Perhaps they’re smarter than most. Dancing in a swimsuit for money?? Hell, I’d do that!!

    Okay, as a new person to Nacogdoches and a new student at SFA, I am 20 yrs old. My major is psy. I came to this website looking to see what is to do in this (my) new town for the next 4 years and found this subject interesting. Never having been to a ‘club’ such as this, just cause I was too young. ( yes I’m female) I personnally don’t think I could do this for a job cause I’m too shy. But I think these women have a right to do what they do. So as a project I decided to ask around. I asked no less than 50 people. Most had heard the story from the paper, by word of mouth, and lately on the internet. I did not find one person who was embarrassed, offended, or thought any of these women were deserving of this attention. Some in fact, didn’t even know the club was there; but admitted they would go and spend money if they knew. So just a question based on the posts here; why is the person who issues the license, checks the license, also the arresting officer? Isn’t that like playing a game where you make the rules, change the rules, and then fine the person for not playing by the rules? I have alot of friends who just started SFA and they do seem to agree with the lack of enforcement of ‘fairness’ in this matter. We are young, but this is and seems crazy to us. How does the one (Kerss) make the rules, enforce, and arrest? My grandparents have lived here for years and own businesses and have never been threatened by BabyDolls or it’s presence. Thank you.

    I personally don’t think that the girls pictures should have been plastered all over the internet and above the fold (or anywhere else) in the newspaper. To clarify, I have never danced, never been in a gentlemen’s club, never known a dancer or owner of this kind of business. I am just a regular citizen like most of you on here. I am a Christian and I don’t see anything wrong with this kind of business. It is not prostitution!!
    Everyone on here that has judged these girls, shame on you!! You are not God and HE is the only One to judge us. “He who is without sin, cast the first stone” I am appalled at some of these comments that I have read.
    I’m not going to go into the politics of all of this…the Sheriff did what he did. It’s done now. I just wish that I saw more compassion for these girls. Do you think that this is what they wanted to do for a living?? As a child do you think that they thought about how much fun it would be to have to dance in front of needy men to make a living?? Give them a break!!
    I was born and raised in Nac., moved away for a long time only to recently return for family reasons and I am shocked and embarrassed by some of y’alls attitudes and judgments. Did I move back to my hometown only to find hypocrites and haters?

      Thank you for your comments. I am nor ever have been “embarrassed” by the fact this club is here so I don’t understand who would be. If things outside your personal comfort zone are disturbing somehow; most people shouldnt leave home. The fact that none of these girls were in a state of nudity, no patrons were detained, only someone who had entered the club after the “raid” began, should be a statement of some kind. I personally have been inside this club. I was more embarrassed in front of my 4 year old grandchild at the state in which young girls were or rather are’t dressed at Walmart. Better yet, any gas station on a Friday or Saturday night. These girls danced around a pole on a stage wearing what was required under the current license. Wearing more than the last 15 yr old I saw IN PUBLIC with her mother. No one forced customers in here. Attend the next bikini car wash in town. Pull up your cooler of beer. Sit in a lawn chair. There you goy Babydolls without A/C.

      I never thought as a child I wanted to be a dancer on a stage for tips, but I do like to dance. So as an income after my divorce and still in the middle (mid-term) for some quick cash to pay my bills and I was confident of how I looked, I thought why the h*ll not? When I saw people, men and yes, women were willing to pay a dollar or a $20 at a time and I could go home each day with almost 300-400 a night? please. I left several times and got what some would call an ‘honest’ job. To be harassed, deal with rude customers, bosses’ BS, and no time off and still waiting on that ‘honest’ bi-monthly paycheck watching bills pile up, and go dance 2 nights and bills are paid, my kids are fed, and I have not done anymore than any girl at the local pool? Get real. Plus here, I HAD bouncers, good music, and working on my degree. And I don’t nor ever have done drugs, that would be determinal to my Criminal Justice degree, Thank you!

    Just a question: Why is it that the same person (1) is the person who wrote the affadavit that seems to be the errs that these employees signed? (2) is the person who each employee was supposed to see regarding obtaining said license (3) is the person who was at the club 3-4 months ago making sure that license(s) the club had were current and correct (4)is the person is the arresting sheriff (5) is the person quoted on KTRE as saying ” I don’t think the people of the county want this club here. It is an eyesore and an embarrassment. I ask, to who? Most people I personally have spoken with either don’t mind or don’t have an opinion at all but to leave others to themselves. OK, so paint the building. Oh. All the listed above is Nac. Co. Sheriff Kerss aka. the only voice of Nac???

    How many people do you think have been killed because of a few women trying to make some money for their family, or pay their college tuition by showing some skin or shaking their boobs or a$es while gyrating around a pole?

    How many men are going to die by watching the women do this.

    How many of you outraged church members report the money you take in with your garage sales on your income tax.

    How many have more than the 3 yard sales per year allowed by law without a sales tax license?

    Morality depends on who is doing what. Should those who eat only vegatables be castigated by those who eat meat, or viceversa?

          At this moment every comment is approved, so it should be visable. Depending on your browser it could be in different places, but if you do not see it, there should be a link type button that says, “older post.”

          The comment filter can need moderation for certain words or phrases common in spam, so it might have been temporally held because of that.

          I try to do as little censorship of people as possible, so if a comment is held it typically is only because the program has not alerted me.

      What was illegal? There was no nudity, which is all the “sob” sexually-oriented business license is required for. The sheriffs dept was in this club 3 months ago and ever year for the past 15 years and there was no mention then nor since.

      according to http://www.manta.com , a small business follower, this club apparently has not been useless to this county. Bad news. Bad press. Bad law enforcement. Perhaps the folks of Nacogdoches need to understand this is 2011 and there will always be people who dont fit into your mold of what is right and wrong. However I believe these people have the right to conduct their business as well as any other. So get the permit if suddenly it is required or not if these are bogus charges which is Sheriff Kerss to admit he was wrong and the people of the city should be no more embarrassed by this than the fact of all the homeless, hungry people and abandoned buildings IN the city limits that have been ignored. These folks are just trying to work and if you dont like the place, don’t go. However they are/have been making money from SOMEWHERE. My guess would be Nacogdoches’ finest citizens. manta.com reports: Baby Dolls in Nacogdoches, TX is a private company categorized under Night Clubs. Current estimates show this company has an annual revenue of $500,000 to $1 million and employs a staff of approximately 1 to 4.
      Imagine how many this years revenue would be with 15-24?? Shame on Kerss. He made up this rule, did not inform the club, and then arrested people for breaking the rule??? Hows THAT WORK?

      Shame on religious fanatics shoving their morales down others. Arresting the employees is like arresting a maid because her boss doesn’t have the right insurance. even if the law states that the employees can be held responsible, it doesn’t mean it’s ethical. Also many girls are from other states, the establishment should of educated them on Texas laws. Anyone of us would of took the word of the owner that they did not need a permit.

      Also the $5 per person aka titty tax Nacogdoches is after is a joke and unconstitutional.

        Ah, OK so is this so called “titty tax” the reasoning behind all of this? The county wants more tax revenue so they are trying to force BD to pay this new tax, but first they have to be designated as a sexually oriented business. So they close them down then force them to pay more taxes and fees in order to reopen.

        Sounds like extortion to me. Maybe the payoff Kerss is looking for are these new “fees”. I wonder what percentage of said fees would go to the Sheriff’s office?

      Honestly WOW, wherever you work, you DO know for a FACT that they possess all the permits, certificates, health permits, and licenses required by law for EVERY employee? Even the newly hired? If not, YOU could go to jail along with any customers. Better check. And honestly, $20,000 a year, ain’t bad these days

      As a former dancer at this club, I DID do my research. I called Nac country sheriff department and was told that dancers did not need a license. Management told me the same thing. I could find no part of any ordinance (several searchs during my employment there) requiring dancers or employees to have a license. I have worked in other clubs in other cities that I selected based on their adherence to ordinances regarding SOBs.

      This is not a legal issue. Even certain members of the county who are working on this case have admitted that the case would doubtfully even go to trial if it weren’t for all of the publicity tied to it.

    Where is the evidence of nudity? When THAT wasn’t found, you look for drugs? When that wasn’t found, they look for anything, such as a non-existent license charge? Now the high Sheriff states (per the Lufkin newspaper) that the club is too close to a residence?? What the heck? I personally know the closest person to this club–and they don’t care! What’s closest to that? A closed liquor store/morgue? Find something else to do….like the meth lab that was operating on Saturday night. The rapist. The robberies.

Thank you Sheriff for trying to find any excuse to get rid of this place. At least give Porky’s the ole wash once in a while. Though, what am I going to do without my humorous ****** around?

    Has no one else noticed that the above affidavit saying: that the person who wrote this, made this rule, requiring this license, responsible for notifying the business of it’s violation, giving (selling) each employee their license, is ALSO the arresting officer? hmm. So if you make the rules up as you go, and someone breaks your said rules, you can arrest them? Also, why is it that the news crew were already there, and as a result…when no nudity was evident, they started searching the place for drugs (which is shown in the pictures), and the only thing they found was in one dancers possession which she admitted, they had to resort to bringing up this license issue. This license was not brought up 3 months ago when the sheriff himself came in to the club and made sure everything was up to par at that time. How embarrassing it would be for them to have made this mistake, with the media there. Remember the grand opening on TV of King Tut’s tomb? Shame on the law enforcement of Nacogdoches, and the fact this has even be an issue on a ‘visitors’ site promoting Nacogdoches. I have lived my entire life here and love my city, this club has never affected my life. The reason this part of town is the way it is, Nacogdoches County was ‘wet’ long before Angelina County was. For years, Angelina County supported Nacogdoches County with their tax dollars (sure it was alcohol money; but you accepted it) and now you have become ashamed of this ‘entrance’ to your city? It’s 11 miles away! Election year!

    Now I might be mistaken, but from what I understand and have been told is that there had been an investigation into this “club” because there were reports of women in this place showing more than they were allowed and for that, yes, you do need a license.
