Texas Penal Code Sec. 38.02. FAILURE TO IDENTIFY. (a) “A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer WHO HAS LAWFULLY ARRESTED THE PERSON and requested the information.”

Unless you have been lawfully arrested, you are under no obligation to provide ID to a law enforcement officer. We have the right to remain silent – even when we are not under arrest.

    • Patriot says:

Yeah, you can beat the rap but you can’t beat the ride.

It is easier to just provide ID and offer nothing more. You do not have to tell law enforcement where you are going or what you are doing. It is none of their business. NEVER consent to a search of your home or vehicle. If they want to search it they can get a warrant. NEVER consent to a field sobriety test or a breath test, again let them get a warrant if they so desire.

Be civil and polite, but offer no unnecessary information. If the cops want to arrest you they will make up an excuse to do so anyway. You can sue them later. 9 times out of 10 if you are polite they will let you go on about your business.

“But let me offer you my definition of social justice: I keep what I earn and you keep what you earn. Do you disagree? Well then tell me how much of what I earn belongs to you – and why?” ― Walter E. Williams

  3. Free Country? says:

Courts have ruled that Law Enforcement Officers are allowed to lie to citizens in order to gain consent for searches. Should it be legal for police officers to intentionally give knowingly false information about the law?

    • Free Country? says:

No opinions on this either way? Personally, I believe honesty is paramount in human relationships. If we can’t expect our own public servants to be truthful to citizens while conducting official business, I’m not sure how we build trust in our communities. LEO’s are people, and as people are deserving of respect. But badges don’t grant extra rights. Respect should be mutual.

What really happened at the sher. deputy’s house? Weird.

  6. Free says:

So, how do Republicans in Nacogdoches feel about a Donald Trump as the presidential nominee?

If you support him now, did you support him from the start? What convinced you he was your preferred choice? If you supported someone else at first, what changed your mind?

    • Righty says:

Trump was not my first choice or second choice for that matter, but I will support him now because the alternative is much worse.

    • Gerry says:

I did not support him. That being said, I respected and had hope for Obama for eight years (and eight years of disappointment) and I will do the same from the orange buffoon. Trump is a left leaning, big gov’t liberal. I did not, and do not, believe a word that comes out of his mouth. I hope he proves me wrong, but thus far (aside from a very few good picks for his cabinet) he has done nothing but prove me right about him being a liberal democrat. His campaign was built on a vitriol of political correctness (which I agree with) and tapping in to the anger of people fed up with the status quo gov’t. People failed to see that people like Trump BUILT Washington DC and he is FAR from an outsider. He said he would drain the swamp, but so far all I have seen as the waters recede are that he is picking the cypress stumps in the swamp to form his administration. He is truly an egomaniacal self-absorbed, low intellect, bully who has nothing but his own self-interest in mind. I am sure that tells you how this Conservative feels about him.

  7. Billy Joe Jim Bobs left shoe says:

Nacogdoches is a racket town, look at what downtown has become. It is filling up with nothing but lawyer offices & banks. Even this page has all these ads for lawyers, how about ads for small business.

    • The other shoe drops says:

Whats stopping a small business from placing an ad? The info for contacting them for placing ads is easily available.

    • Downtown lowdown says:

Is there a new bank downtown? Have not seen that… I have seen a new clothing store and a couple of new restaurants.

      • Amy Mehaffey - City of Nacogdoches says:

We work very hard and devote a great deal of city resources to making sure Downtown is viable and profitable. There are FAR more retail stores, restaurants, personal services, art galleries, and gift shops than there are banks and lawyers. Our downtown merchants and the Main Street office enjoy these folks as well because it keeps downtown busy and brings people to this part of town even when they aren’t shopping or eating out.

Also, the valuation per acre downtown is 4 times higher than that of let’s say, Walmart. This is due to the fact that Downtown is densely developed (lots of stores in a small space) and this creates great value to our economy in Nacogdoches. The market valuation for downtown is $20,365,870.00 per the 14.435 acres whereas Walmart is $7,612.95 per it’s 27.118 acres of property.

I invite anyone on this feed to call me at the Main Street Office or come by City Hall. I’d love to talk more about what we do and always welcome community volunteers for various events.

  8. John Q Citizen says:

I would like for the local Law Enforcement agencies to publicly clarify their positions on Gun Control, and particularly, Gun Confiscation. Put another way, I want them to clarify, publicly, wether they would assist Federal Authorities (or other such as UN) in rounding up citizens’ Fire arms, OR if they would stand by their citizenry and obstruct such an action to the best of their abilities. NPD has an up armored vehicle, meant for Iraq, as part of its fleet; Everyone knows that the Federal Government sends ample funding to local law enforcement. I want to know to whom they are actually loyal to.

    • Patriot says:

The Nacogdoches County Militia will not sit idly by while a gun grab occurs. It would be nice to know if the local law enforcement will be working with us or against us though.

      • C Dub says:

I would love information on how to get more information on the Nacogdoches County Militia. Is there a way to do that?

    • Billy Joe Jim Bobs left shoe says:

This is a data base for all weapons & equipment the LEOs have received from federal 1033 program.

    • What? says:

No one has said they are “coming for your guns.” Other than people hoping to keep you scared. And I see it’s working.

      • C Dub says:

Of course they do not say they are coming for our guns, instead they change laws little by little and dry up the ammo market raising prices of ammunition by buying BILLIONS of rounds for branches of the federal government that do not carry or use firearms (e.g. the USPS, SSA, and the IRS). They infringe and threaten our rights one inch at a time. Open your eyes. It is not about fear, it is about LIBERTY. We need to retain our love of Liberty for all people. It is the only way this Republic will survive.

        • TJ says:

You should know by now cops are not with ya but against you! They will take your guns and your ammo. And God forbid if you have some type of narcotic then you’re really screwed! They will seize everything and make your life a living hell. Most of them are thiefs or worse than so called criminals. They no longer serve and protect they bully and find you guilty until proven innocent. They lie and offer you certain things to “help you” help yourself. At the rate they throw ppl in jail who’s gonna pay there salary? So called non violent drug offenders who cant get a job because some prick cop wanted to make a name for himself?!? Why do they need to dress like military and wear camo and carry AR-15 and justify spending tax payers $ on armored trucks to ram peoples houses. And they wonder why people are pissed. Seems like we are becoming a policed state. I certainly don’t want or need them to “protect” me! So yea dont let them fool ya or believe the hype about you bein parinoid. They would love to take anything they could from you. Guns, home, cars they need to fund there donut fund. And with current events how many cops does it take to use deadly force. There not your friend and its obvious they will shoot 1st ask later. Know your rights educate yourself against law enforcement. Or you might end up in jail or dead. Remember its we the ppl by the ppl and God bless America

          • LOL says:

You expect the police to let a worthless thug, aka non violent drug head get away with having an illegal gun and dope? They don’t stop you from finding a job, your drug use and jail time does. Quit blaming the police for your laziness and unwillingness to be a productive citizen of the USA! Bet you would like welfare to pay for you to live this way also??? WOW! You are a piece of ….!

            • 420 says:

              Generalize much?

So what about the legal gun owner who works for a living and also happens to enjoy some Cannabis every now and then?

              • anonymous says:

Last I checked cannabis is still on the federal registry of illegal substances and illegal in texas. Soooo if you are using illegal substances what does that make you? Certainly not a law abiding gun owner.

                • Free Country? says:

Making something illegal doesn’t make it a crime. Same as with gun ownership. No victim, no crime.

                • 420 says:

My gun has never killed anyone and neither has my bong. Civil disobedience in one instance does not equate to being an illegal gun owner. One day Texas laws will change like so many other states already have. The Libertarian party will fill the void left by the imploding Republican party and all good patriots will rise up and overthrow the current oppressive regime.

So I saw Andy House was sentenced to a year in prison for his role in the Bugatti insurance scam. What happened with Lloyd Gillespie for his role in the scam?

    • Billy Joe Jim Bobs left shoe says:

One year for a political scam? People get over 1 year for possession of certain plants with medicinal properties, the hypocrisy of amerika.

      • Bugatti says:

I would not call insurance fraud a “political scam”. House and Gillespie bought a million dollar sports car and then drove it into a salt marsh in order to collect the insurance. They might have gotten away with it if someone had not video taped the “accident”

        • Billy Joe Jim Bobs left shoe says:

One year and one day in a federal prison, so he will serve 10 months if he is a good boy.

          • Soggy Bottom says:

Yeah, House got 366 days on the Federal charges, I already knew that. What if anything happened to Gillespie? He was a defendant in the insurance civil case. Was he ever charged or indicted in the criminal case?

    • TUCHE says:

TUCHE TUCHE! ashley has no heart and could care less about aallllll eeevvveeerrryyytthhhiinngggg & eeevveerryyyoonnneeee! The only thing ashley nicole gleitsmann sincerely cares about is herself, how she looks, the material things she has, having the most, looking the best, how many boys she can drag along with her, how much she can buy, how many people she can use, who all she can abuse, and taking advantage of everything/everyone she possibly can as fast as she possibly can… that is all ashley has ever cared about and all she ever will care about! HHAA what justice? In the past month alone ashley gleitsmann has gotten 5 different charges “dismissed” and 2 different charges she was given the “minimal punishment” for just last week, not to mention aaalllllll her past arrest/charges/convictions before now that were “waived”, “dismissed”, “dropped to a lesser offense”, “deferred”, etc! IT IS ABSOLUTELY PATHETIC, ASHLEY IS ABSOLUTELY PATHETIC! She deserves to be & she should be 6 ft under by now hell! CALL IT HOW YOU SEE IT OR QUIT KIDDING YOURSELF SERIOUSLY!!!!!!!!!

  14. Fight-the-lights says:

There are WAY TOO many lights in Nacogdoches.

When you drive down North street and hit a red light, look at why you are stopping. Chances are the light is stopping you and all the other traffic to allow traffic from a parking lot or a dead end residential street. OR it is a double light with no real purpose

This is ineffective AND dangerous. It slows traffic to a crawl on North Street and blocks passage between North and University (on Austin and Starr)

  15. Handicapped lady says:

Why is it that people who have no placard or handicapped plates on their car think it is their God given right to park in places marked for handicapped people? I use a cane because of peripheral neuropathy, (bilateral). My feet are numb and hurt me to walk. My lumbar spine is degenerative. Even I will park in a space that is reasonably placed a distance that I can walk before I use handicapped parking because there are people worse off than I am. WALMART is the worse place in town to monitor their spaces!! I have talked to them and they say the Police are supposed to do this! The Police say Walmart is responsible for the spaces! If you write down the lisence number down and turn it in to the Police they will come out and issue a $75.00-$300.00 ticket. Have some respect, people! Turn in the lisence plate number! Chances are you will only have to do it once!

    • Abled-Body guy says:

I hate it when handicapped drivers park in normal spots and take up 2 parking spaces.

      • Celeste says:

Sorry, but sometimes there are no spots for handicapped and their door for the wheelchair ramp is on the side. If you see a handicapped spot used by someone who doesn’t have authorization to use it write down their license number and turn them in!!!

What are we demonstrating by example for the youth of today? Better yet for the adults of today and the citizens of this community? Crimanls and Offenders will never have to learn, get help, take responsibility for their own actions, commit to making good choices over their previous horrific choices, establish and begin building and reflecting good character if UNJUST, UNLAWFUL, and UNFAIR circumstances like Ashley Nicole Gleitsmann’s multiple unlawful actions, convictions, and cases continue to repeat and prevail as being okay in our Court Rooms, in our Community, and in our Society. Let me guess, her repeating theft choice and actions and arrest should be forgiven too and swept under the extremely dirty rug as well huh.? Why not, look at everything else the courts and law enforcers have proven are okay and a crimal can get away with.? After all she just, very unjustly and very ignorantly, got to walk out of Jail a free woman less than 3 weeks ago.

What malicious gossip! The writer needs to get the facts straight. Fact: Yes, the girl has problems and no one knows this better than her family. They love her and want to get the help she needs. Fact: No, her grandpa or no other family member is the Mayor of Nacogdoches and does not have any influential pull. I don’t know where that came from. Fact: No one has been paid off. Do you think that you can go and offer a judge money and everything will be taken care of. I don’t think so. Also, she is not the only person with a problem that ends up in jail multiple times. Why pick on her and her family. Do you have an agenda? We need a little more love in this world. Don’t judge unless you have walked in their shoes for a while.

Ashley Nicole Gleitsmann, a suspect of 27 years age, was detained according to information received from Nacogdoches County, TX officials on Friday, April 4th, 2014.

Based on Texas records obtained by MobileMugs from the Nacogdoches County Sheriff’s Office, Gleitsmann was booked on Friday, April 4th, 2014. Gleitsmann has allegedly been charged with one offense.

    • Joe says:

This is false information. I know her and her family. That charge was from many, many years ago. The charge had nothing to do with “Injury ” to an elderly. It was over a confrontation between her calling trying to call the police over something horrible that happened with the elderly females grandson and her not wanting the police to be called on him. No child was involved. No injury occurred.

Nacogdoches woman’s arrest latest in series of troubles with law
    Donna McCollum
    Feb 28, 2013 05:43 PM
NACOGDOCHES, TX (KTRE) – There are hundreds of court files in every county courthouse involving a second chance for the violator.

Ashley Nicole Gleitsmann was in jail this week after being arrested for driving while intoxicated. She’s only 26, but has a rap sheet longer than some felons twice her age.

Since 2005, Gleitsmann has been in and out of jail and prison for numerous felony and misdemeanor cases. It began when Gleitsmann admitted to striking and biting a 65-year-old woman. The courts allowed Gleitsmann to go through a six-month state lockdown substance abuse program.

Assistant county attorney Stephanie Stephens can’t talk about Gleitsmann’s numerous cases, but she knows from experience as both a prosecutor and former defense attorney, sentencing leniency is common among substance abusers.

Gleitsmann received numerous rehab deals, has been in and out of jail, monitored, and has had charges reduced or even dropped. Eventually, multiple motions to revoke her probation were recommended. Even so, additional chances still came her way.

“If you put someone on probation for driving while intoxicated which happens every day of the week, all over the country, and you wake up tomorrow, and that person has hit a school bus full of children or committed some other crime while they’re intoxicated, you know you’re going to have to look at yourself in the mirror every day,” Stephens said.

  25. Where IS The JUSTICE says:

It is an ABSOLUTE DISGRACE and BEYOND UNJUST that a so called woman with MULTIPLE FELONY CONVICTIONS and MULTIPLE MISDEMEANOR CONVICTIONS gets to walk out of jail as a free woman, when she should be serving SEVERAL YEARS IN PRISON, all because her grandpa is the Mayor of Nacogdoches and the obviously right people have been PAYED OFF. It must be nice to be able to get away with murder in a small town because of the last name GLEITSMANN and because GRANDPA & MAMA have money. What about SUFFERING THE CONSEQUENCES for your actions and choices? How about a blood test every other day for ALL THE PILLS she is already popping once again? What about KEEPING THE PEOPLE SAFE by keeping the KNOWN CRIMINALS off the streets? How about FAIRNESS IN OUR COURTS? What happens when she is able to DRINK AGAIN and decides to put HER OWN CHILD AGAIN AANNDD ALL OF US AND OUR CHILDREN in DANGER for the HUNDREDTH TIME by BREAKING THE LAW once more and getting BEHIND THE WHEEL OF A VEHICLE?

    • Anonymous says:

Amen, Amen. That could not have been stated with more honesty! It is an utter shame that we the people of Nacogdoches have to constantly watch out for the known dangerous offender in our own back yards due to these exact unjust circumstances.

Woman falls through ceiling, resists arrest

By Paul Bryant | Updated 5 months ago

About 24 hours after posting a combined $7,500 bond for three charges, a Nacogdoches woman was arrested again on a parole warrant — but not before allegedly hiding from officers in an attic, falling through it and clinging to a tree in her backyard.

      • Joe says:

You should get your facts straight before commenting on a post that is completely inaccurate. You’re comment is an “utter shame.” She isn’t a “dangerous offender” she’s a human being that deserves respect. A dangerous offender would be a rapist or murderer – not someone who has gone to jail over charges related to substance abuse (which are a result of addition to medications she gets prescribed to by the doctors in “your own beckyard”) You don’t know her personally, you don’t know what she has been through, and you don’t know the whole story. So instead of making your disrespectful, degrading, inappropriate comments why don’t you get your facts straight first. Maybe you should spend your free time enjoying Gods beautiful blessings on this earth instead of publicizing your negative opinions on someone and a situation you know nothing about.

        • Amen says:

I however DO know her personally and have witnessed and been victimized by her illegal actions, as well as the rest of Nacogdoches county by her illegally driving while intoxicated and under the influence of drugs and alcohol (not to mention while being pregnant with her daughter).
