In an effort to deter impaired driving, the Nacogdoches Police Department, in conjunction with the Nacogdoches County Attorney John Fleming’s Office, will observe a “no refusal” weekend from Friday, May 25 thru Tuesday, May 29, 2012.
Persons suspected of impaired driving will be asked to take a breath test to determine blood alcohol levels. In the event the suspected drunk driver refuses the test, a search warrant will be obtained and a blood test taken. Nacogdoches County Court at law Judge Jack Sinz has agreed to serve as the magistrate on call.

Some of the people who win on appeal should sue the police department. Maybe that would make them rethink their gestapo tactics.
“…a search warrant will be obtained…” No, not really. I’m really surprised no lawyers jump on this to tell the public that the warrant will ONLY be obtained if the police can show probable cause to get the warrant…So the same amount of evidence to arrest is what they need to get the warrant…Sheesh
Bob, what this is telling people is that the County Attorney and Judge have agreed to OK any warrants the police ask for no matter what. I bet there haven’t been two cases where the judge has refused because he felt like PC was not met. And, it’s not because the cops are all that great at developing PC it’s because they have already made up their minds.

Blood search warrants are common practice these days, not just in Nacogdoches. Kind of easy to reach probable cause, my grandmother has rnever, ever drank a drop of alcohol in her life, but she can point someone that has out in a heartbeat.
