Thomas Kerss (Nacogdoches Sheriff): Arrest made for falsifying evidence on a murder case

     James Patrick Capps, 31 years of age, of Nacogdoches was arrested yesterday evening on two 3rd degree felony counts of Falsifying Evidence. The arrest came after Texas Rangers and Nacogdoches County Sheriff’s Office Investigators learned that Capps had falsified documents and forged documents regarding the Marcia Kelly case, including a bogus notorized statement allegedly made by local Texas Ranger Tom Davis.

     Ms. Kelly is a convicted felon serving a life sentence for her role in the 2006 murder for hire killing of her husband, James Kelly. Capps has been sympothetic to Marcia Kelly since her arrest and was attempting to assist her in having her conviction overturned. He even helped establish a web.site where the false documents and other false information was posted for public viewing (www.freemarciakelly.com) following the murder being aired on the “Snapped” television program.

     Capps remains in the Nacogdoches County Jail awaiting bond to be set.
