INFORMATION FROM 0600 11.29.10 to 0600 11.30.2010

     THEFT; 2000 BLOCK OF SOUTH STREET. A SUSPECT WAS FOUND TO HAVE PLACED NUMEROUS PACKAGES OF SOCKS IN HIS COAT AND ATTEMPTED TO LEAVE THE STORE WITHOUT PAYING. THE SUSPECT WAS ARRESTED.

     BURGLARY OF A VEHICLE (2 COUNTS); 1100 BLOCK OF NORTH UNIVERSITY DRIVE. OFFICERS RESPONDED TO TWO VEHICLE BURGLARIES IN A PARKING LOT. BOTH VEHICLES WERE ENTERED BY FORCE AND A PURSE, IPOD, VARIOUS CREDIT CARDS AND A WALLET WERE TAKEN.

     DWLI; 100 BLOCK OF BREMOND STREET. OFFICERS STOPPED A VEHICLE FOR TRAFFIC. THE DRIVER WAS FOUND TO HAVE A SUSPENDED LICENSE AND NO INSURANCE. THE DRIVER WAS ARRESTED.

     BURGLARY OF A VEHICLE ( 2 COUNTS); 4900 BLOCK OF NE STALLINGS DRIVE. TWO VEHICLES WERE FORCIBLY ENTERED AND A WALLET, PURSE, CASH, CHECK BOOK AND CREDIT CARDS WERE STOLEN.

     BURGLARY OF A HABITATION; 800 BLOCK OF SUMMIT. ENTRY WAS FORCED TO A RESIDENCE AND A TELEVISION, A WII GAME STATION AND A DELL COMPUTER WERE STOLEN.

     DWLI; 800 BLOCK OF PARK STREET. A VEHICLE WAS STOPPED FOR TRAFFIC. THE DRIVER HAD A SUSPENDED LICENSE AND NO INSURANCE. THE DRIVER WAS ARRESTED.

     THEFT; 200 BLOCK OF EAST STARR. A TREK 4300 BICYCLE WAS TAKEN FROM OUTSIDE A RESIDENCE.

     BURGLARY OF A HABITATION; 3400 BLOCK OF EAST MAIN. ENTRY WAS MADE TO A RESIDENCE AND A 54” TELEVISION WAS REPORTED STOLEN.

     DEADLY CONDUCT; 200 BLOCK OF FLORA STREET. COMPLAINANT REPORTED THAT SOMEONE IN A PASSING VEHICLE FIRED SEVERAL SHOTS IN THE DIRECTION OF THE RESIDENCE. NO ONE WAS INJURED.

     HIT AND RUN; 100 BLOCK OF NORTH UNIVERSITY DRIVE. COMPLAINANT REPORTED THAT A VEHICLE STRUCK HIS, CAUSING HIM TO STRIKE ANOTHER VEHICLE. THE SUSPECT VEHICLE LEFT THE SCENE. THE THIRD VEHICLE THAT WAS STRUCK ALSO LEFT THE SCENE.

     THEFT; 900 BLOCK OF SCARLET OAK. COMPLAINANT REPORTED TRANSFERRING MONEY TO AN UNKNOWN SUSPECT AS A DOWN PAYMENT FOR A LOAN. THE DOWN PAYMENT WAS SENT TO CANADA BY WIRE TRANSFER. THE COMPLAINANT DID NOT RECEIVE THE LOAN, AND HAS BEEN UNABLE TO RECONTACT THE SUSPECT.

     POSSESSION OF MARIJUANA; 500 BLOCK OF EAST COLLEGE. OFFICERS STOPPED A VEHICLE FOR TRAFFIC. THE DRIVER AND A PASSENGER WERE FOUND TO BE IN POSSESSION OF SUSPECTED MARIJUANA. BOTH WERE ARRESTED.

     DWLI; 3500 BLOCK OF SOUTH STREET. A TRAFFIC STOP REVEALED THAT THE DRIVER HAD A SUSPENDED LICENSE AND NO INSURANCE. THE DRIVER WAS ARRESTED.

Wright (Democratic): Moving, forums, elections, Tom Delay, and a letter in a bottle

     Fellow Nacogdoches Democrats,

     I hope everyone had a wonderful Thanksgiving holiday break and enjoyed the company of family and friends. I also trust you were able to get some much-needed rest from our previous busy political season. While there is more where that came from as we look toward the upcoming Christmas Holidays, there are few important things we need to accomplish beforehand, the main one being moving out of our office. We need your help on Saturday! Without further ado, here is the all-important laundry list as we begin to close out this year and prepare ourselves for the 2012 elections:

     1) Saturday, Dec. 4th (beginning at 10AM) — We will be meeting at Headquarters (901 E. Main) to move out of our office! We need everyone to come and take a few goodies, lift a few things, and clean a bit. We must be out of the office by December 15th, so this weekend is a good time to get it done. Pizza will be provided for lunch and there may be some informal planning and discussion for 2011 going on as we clean. While it’s not necessary to RSVP to attend, it would be helpful to email me (stephen.wright15@gmail.com) to let me know you’ll be there. Come on out and help fellow Dems put a close to the 2010 election season!

     2) Tuesday, November 30th (7PM) — Several groups are hosting a forum at the Recreation Center (1112 North St.) to give public input for the legislative sunset review of the Texas Commission on Environmental Quality (TCEQ) and the Texas Railroad Commission (TRC). These are two needed agencies which should be more active in regulating Texas industries to make sure our citizens have adequate environmental protection. Come out on Tuesday to make your Nacogdoches County voice heard!

     3) For those of you in the Southwest Ward, run-off voting for the unexpired term is beginning. Early voting will take place at the Recreation Center (1112 North St.) each day this week from 8-5, as well Monday-Wednesday (Dec. 6-8) of next week from 8-5, and Thursday-Friday (Dec. 9-10) of next week from 7-7. Election day is Tuesday, December 14th and will take place at the Recreation Center from 7-7. David Norton and Mary Ann Derby are the candidates. While we do not endorse candidates in non-partisan elections, I encourage you to educate yourself on the candidates and ask fellow Democrats about their recommendations.

     4) Former Congressman Tom Delay was recently convicted of money laundering and conspiracy to commit money laundering. The conviction stemmed from Delay’s actions in illegally funneling $190,000 to Texas Republican candidates in 2002. While the verdict will be appealed, it was a good reminder that Texans expect our elected officials to follow the law, especially when it comes to clean and fair elections.      On a final note, one of our concerned Democrats penned an excellent letter-to-the-editor which has yet to be published in our Daily Sentinel. The letter is below. Come help us close the 2010 chapter on Saturday (10AM at Headquarters) and let’s continue in our tireless quest to make out state Democratic blue!

Letter to the Editor, Nacogdoches Daily Sentinel

     Re: Sentinel Article November 14, headlined “Christian Claims Win in Beach-front Battle”

     State Representative Wayne Christian may not be so happy about his apparent win of extending his property onto the beach when the public discovers that his “win” likely means the loss of citizens’ rights of future access to the beaches of Texas. And ire toward the Texas Supreme Court’s ruling could well include the court.

     The Open Beaches Act was originally passed by the Texas Legislature in 1959. The result of this act was that the state established the right of the state to file a lawsuit to
remove structures which “become seaward of the vegetation line as a result of natural processes such as shoreline erosion” [Tex. Nat. Res. Code, Sect. 61.065(a)]. The act further guaranteed the right of the public to access the beaches of Texas.

     Christian obviously thinks that he should not have to obey our Open Beaches law because he is a private property owner, and he believes his private property trumps the state’s right to serve its citizens.

     Unfortunately, the beaches of Texas are constantly changing. Most of the beaches are losing several feet a year because of wind, waves, and yes, hurricanes. The person who filed the lawsuit cited in the Sentinel article has property on West Galveston Island, which is losing approximately seven (7) feet per year of beach.

     The real question is whether the state should abandon 200 years of history protecting the public’s right to access and use of our public beaches, or whether, as the current Supreme Court has ruled (in clear disregard of 200 years of case law), the private property should be allowed to “crawl” onto the beach and into the ocean as the beach erodes. This will allow a succession of “possessors” to own the beach as it erodes. This of course will “disown” the rights of the citizens of this state and of tourists to Texas to access and use the beaches. By the way, Texas beaches are estimated to bring in seven billion seven hundred million dollars ($7,700,000,000) per year to the economy of Texas, as reported by the Texas Shore and Beach Association.

     The Houston Chronicle makes an interesting observation: that the case at issue here jeopardizes the public’s right to open beaches “recognized over the past 200 years, and threatens to embroil the state in beach-front litigation for the next 200 years”. Don’t I remember Representative Christian proudly taking credit for the passage of tort reform to limit lawsuits? Or was that tort reform only for lawsuits against moneyed interests, especially big corporations and big spenders that donated to his party?

     In the past, sellers of property on or near the coastline in Texas have been required to include in the sales contract a “Disclosure Notice Concerning Legal and Economic Risks of Purchasing Coastal Real Property Near a Beach”. This notice specifically warns that “if you own a structure located on coastal real property near a gulf coast beach, it may come to be located on the public beach because of coastal erosion and storm events, and that owners of structures erected seaward of the vegetation line (or other applicable easement boundary) or that become seaward of the vegetation line as a result of natural processes such as shoreline erosion are subject to a lawsuit by the State of Texas to remove the structures”. The state’s rules also provide for payment to the person who loses the property through erosion of the beach. Christian had to sign off on this notice. If he was that worried about losing beachside property, he shouldn’t have bought it. Never mind that he would be reimbursed for loss. But perhaps Christian thinks he is too important to be limited by the history, laws and rules of Texas.

     BURGLARY OF A HABITATION; 2600 BLOCK OF NORTH UNIVERSITY DRIVE. AN APARTMENT HAD FORCED ENTRY AND AN XBOX, GAMES TWO TELEVISIONS, A LAPTOP COMPUTER AND CLOTHING ITEMS WERE STOLEN.

     THEFT; 100 BLOCK OF RUSK STREET. UNKNOWN PERSONS REMOVED A BICYCLE FROM COMPLAINANT’S FRONT PORCH. THE BIKE IS A ROYCE UNION MEN’S 10 SPEED MOUNTAIN BIKE THAT IS WHITE IN COLOR.

     FAILURE TO IDENTIFY; 100 BLOCK OF SIDNEY STREET. OFFICERS CONTACTED AN INDIVIDUAL ON A TRAFFIC STOP, WHO GAVE OFFICERS A FALSE NAME. THE SUSPECT WAS FINALLY IDENTIFIED AND HE WAS ARRESTED.

     DWLI; 100 BLOCK OF MUCKLEROY STREET. OFFICER CONTACTED A DRIVER ON A TRAFFIC STOP. THE DRIVER WAS FOUND TO HAVE A SUSPENDED DRIVERS LICENSE AND NO INSURANCE. THE SUSPECT WAS ARRESTED.

November 28 Photos: Plane Crash

     November 28 at 11:35 a.m.

     Location is on FM 225 at County Road 711, Nacogdoches County.

     The aircraft is a Piper Seneca II.

     Owner and pilot is Jeffery Clarke, 63, retired, from Sugarland, Texas.

     He is in stable condition with back injuries at Nacogdoches Medical Center.

     The aircraft was in route to Shreveport, Louisiana, from Sugarland when fuel pressure in both engines were lost. RPMs were also lost in both engines and Clarke attempted an emergency landing at the Nacogdoches County airport. He crashed north of the runway injuring the pilot.

     The weather conditions were clear and cloudy. The crash was reported by Trooper Jay Stone.

     P10~20940~ 2120 PEARL ST #213 ~ ASSAULT ~ COMPLAINANT, ALLEGES THAT SHE WAS OUTSIDE WALKING WHEN SHE ASKED A FEMALE NOT TO BE CURSING OUT LOUD. COMPLAINANT STATES THAT THE SUBJECT GRABBED HER AND ASSAULTED HER BY PULLING ON HER HAIR AND KICKING HER. COMPLAINANT RECEIVED VISIBLE INJURIES. THE COMPLAINANT WISHES TO FILE CHARGES, THE SUSPECT WAS IDENTIFIED.

     P10~20920 ~2000 SOUTH ST ~ FAIL TO I.D. FUGITIVE. SUSPECT WAS STOPPED FOR TRAFFIC VIOLATIONS THEN PROVIDED OFFICERS WITH A FALSE NAME AND DATE OF BIRTH. THE SUSPECTS CORRECT I.D. WAS DISCOVERED AND HE WAS FOUND TO HAVE SEVERAL OUTSTANDING WARRANTS FOR HIS ARREST. SUSPECT WAS TAKEN TO THE COUNTY JAIL FOR DETENTION. GARCIA, IGNACIO ARRESTED

     P10~20918 ~2430 SE STALLINGS ~ RECOVERED PROPERTY. AN UNKNOWN TRUCK PULLING A LARGE RED FARM EQUIPMENT TRAILER LOST THE EQUIPMENT WHEN THE HITCH ON HIS TRUCK BROKE. HE DROVE AWAY AND LEFT IT IN THE ROADWAY. IT WAS TOWED FROM THE SCENE.

     P10~20907~ 3230 PEARL ST #30 ~ CREDIT CARD ABUSE. OFFICER MADE CONTACT WITH COMPLAINANT WHO STATED THAT HE LEFT HIS WALLET ON TOP OF A GAS PUMP WHILE FUELING AND THEN DROVE OFF. WHEN HE RETURNED A SHORT TIME LATER THE WALLET AND ITS CONTENTS WERE GONE. CREDIT CARD COMPANY HAS ADVISED THAT NUMEROUS CHARGES HAVE BEEN ATTEMPTED ON THE VICTIMS CARDS.

     P10~20931~ 3220 NORTH ST ~ ROBBERY ~ COMPLAINANT, ALLEGES THAT A KNOWN INDIVIDUAL ASSAULTED HIM CAUSING INJURIES. COMPLAINANT STATES THAT WHEN ON THE GROUND THE KNOWN SUSPECT REMOVED HIS CELL PHONE. THE CELL PHONE IS A NOKIA. COMPLAINANT REFUSED TO PROVIDE OFFICERS WITH ANY OTHER INFORMATION CONCERNING THE OFFENSE.

     P10~20937~ 5000 N UNIVERSITY DR ~ DWI ~ OFFICERS RESPONDED TO THE SCENE OF A MOTOR VEHICLE CRASH. UPON ARRIVAL, OFFICERS FOUND THOMAS STEFAN ALLEN IN A STATE OF INTOXICATION. ALLEN REFUSED TO PERFORM SFST AND ALSO REFUSED TO SUBMIT A SPECIMEN. OFFICERS REQUESTED A BLOOD SEARCH WARRANT. ALLEN WAS ARRESTED AND TRANSPORTED TO MEMORIAL FOR THE BLOOD DRAW THEN TO NLEC FOR HOUSING.

     P10~20939~ 1216 SOUTH ST ~ POM ~ OFFICERS CONTACTED A VEHICLE FOR A TRAFFIC VIOLATION. UPON CONTACT, OFFICERS DETECTED AN ODOR OF BURNT MARIJUANA OMITTING FROM THE VEHICLE. A CONSENSUAL SEARCH OF THE VEHICLE REVEALED A USABLE AMOUNT OF MARIJUANA INSIDE THE CENTER CONSOLE THAT NONE OF THE OCCUPANTS WOULD CLAIM. MATTHEW CASTELLANO, EDGAR GONZALEZ, AND HERON ROMERO WERE ARRESTED BY POLICE.

     P10~20944 ~ 3801 NORTH ST ~ DWI ~ OFFICERS RESPONDED TO A REPORTED DISTURBANCE AT THE BOWLING ALLEY. UPON ARRIVAL, THE SUSPECTS HAD LEFT THE SCENE IN A MOTOR VEHICLE. OFFICERS LOCATED ONE OF THE ACTORS IN THE DISTURBANCE. AFTER SPEAKING WITH THE SUBJECT, IT WAS DETERMINED THAT THE DISTURBANCE WAS VERBAL ONLY. November 27 Crime Report: Party foul

     10-20883-2500 Blk Jonah St-Assault M-A-victim advised that she and a friend of hers were discussing who would drink the last beer. Victim reached into the refrigerated and suspect slammed the door on her head he then struck her in the face with a closed fist. Johnson, tom was arrested at the scene.

     P-10 20786 – Theft @ 200 Blk. Russell Blvd. – Comp. advised that someone took $100.00 out of her billfold while in her friend’s car.

     P10-20291(supp.) – Burglary 1000 Blk Douglass – Officers observed Jake Deloney walking in the 1400 blk. of N. Univ. Knowing he had an outstanding BOH warr. Mr. Deloney was arrested.

     P10-20820 – Burglary 2800 blk NW Stallings – Comp. stated that unknown person broke into his bldg. and stole some medicine, a shotgun and a saw. Total loss @ $150.00

     10-20873- -300 Blk Ellington – POM, POCS- Billie Turner was contacted at her apartment in reference to a theft call. Officers observed a marijuana pipe in plain view. Turner advised she had a couple of marijuana roaches and a hydrocodone pill on her person. The items were seized and Turner was arrested.

     10-20875-1600 Blk Dolph St-Assault M-A-F/V-Girlfriend and boyfriend got in to a physical altercation. The victim received injury to her lip, suspect was gone on arrival of officers.

     10-20881-1100 Blk N University-Comp advised he left his I-phone in the dressing room of a local department store. When he returned to get it the phone was gone.

     10-20871-300 Blk Ellington-BMV-Comp advised that her purse was taken from her vehicle. She advised that she saw a friend of hers, standing by the vehicle. Possible suspect was contacted and arrested for unrelated offenses. Other friends of comp then came to the PD and advised that they observed the suspect with the purse and throw it out the window after retrieving cash from it. The purse was recovered.

     10-20892-1500 Blk North St-BMV-Comp advised that her vehicle was broken into by an unknown subject, by busting out the driver’s window. A bottle of perfume was the only thing taken. Perfume was valued at $18.00. The window was valued at $150.00

Obituary: Albinas Keistutis Jurkonis

Albinas Keistutis Jurkonis

     Mr. Albinas Keistutis Jurkonis, age 88, of Nacogdoches, Texas, passed away Wednesday, Nov. 24, 2010, at Westward Trails in Nacogdoches.

     Mr. Jurkonis was born July 21, 1922, in Springfield, Illinois, to Paulus Jurkonis and Kaze Mikelonis Jurkonis. He was a retired industrial engineer and U.S. Navy veteran, serving as an aviator during World War II and the Korean Conflict.

     Survivors: his daughter, Aldonna Kroeker and husband Dennis of Nacogdoches, Texas; son, Paul Jurkonis and wife Lisa of LaVergne, Tennessee; grandchildren, Shauna Reiley of Bedford, Texas, Paul Jurkonis II of Needville, Texas, and Caleb Jurkonis of Lavergne, Tennessee; great-grandchildren, Kaelyn Reiley and Matthew Reiley, both of Bedford, Texas.

     He was preceded in death by his parents; his wife, Mildred Jurkonis; brother, Vit Jarkonis; and sister, Aldona Jarkonis.

     Funeral services are set for 2:30 p.m. Monday, Nov. 29, at Redeemer Lutheran Church, 2306 Appleby Sand Road, Nacogdoches, with Pastor Robert Kobler officiating.
Memorials may be made to the Alzheimers Association Southeast Texas Chapter, 2242 W. Holcombe Blvd., Houston, TX 77030.

Obituary: Donald W. “Don” Burk

Donald W. “Don” Burk

     Mr. Donald W. “Don” Burk, age 81, of Nacogdoches, Texas, passed away Wednesday, Nov. 24, 2010.

     Mr. Burk was born April 20, 1929, as a son of T.H. Burk and Madge Christopher Burk. Don was a graduate of Nacogdoches High School and Stephen F. Austin State University. He retired as an educator, rancher, and dairyman. He was an avid lover of horses.

     He was preceded in death by his sister and three brothers.

     Survivors include five nieces and three nephews.

     Funeral services are set for 2:00 p.m. Sunday, Nov. 28, 2010, at Cason Monk-Metcalf Sunset Chapel, 5400 North Street, Nacogdoches, with Bro. Glen Matlock officiating. Interment will follow at Rock Springs Cemetery on FM 698, Nacogdoches County.

     Visitation will be held Saturday, Nov. 27, from 5:00 to 7:00 p.m. at Cason Monk-Metcalf,5400 North Street in Nacogdoches, Texas.

November 26 Crime Report: No number, no phone

PUBLIC INFORMATION REPORT FOR FRIDAY, NOVEMBER 26, 2010
INFORMATION FROM 0600 11.25.10 to 0600 11.26.2010

     1507 North (PI & Criminal Mischief) Victim reported a drunk man approached her in the club, made several sexual comments towards and when she ignored him, he took her phone and threw it in a pool. Officers located the suspect, found him intoxicated and placed him under arrest.

     1300 block Ritchie St. (BOH) Victim returned home and found the back glass broken out of her back door. A lap top, several rings and music CDs were taken. Another complainant was at work and could not respond. When he arrives back more items may be added.

     400 block Oakhill Plaza Dr. (Abandoning or Endangering a Child) Two subjects left six children alone at home. The oldest was 8 years old and the youngest was one. After an hour, two responsible adults showed up. The children were released to them.

     3831 NE Stallings (POM) Vehicle was stopped for traffic charges, the driver and passengers smelled of marijuana. A small bag of marijuana was found in one of the occupants purse. She was arrested

     100 block Kent St (BOH) Victim stated he was not positive when this occurred. A set of Chevy wheels are missing from behind his home. Inside the home a Wii , PS2, and a Glock 9mm Model 22 was taken.

     2800 block North St. (Assault FV) Female subject and her boyfriend got in a fight with each other at her mom’s house and got kicked out. She was going somewhere else and he kept following her against her wishes. She struck him in the face. He called the police. They were separated.
